According to petitioner, her only son passed away on 02.07.2025 at the age of 36 years. Petitioner applied for survivorship certificate. Her application was rejected by Sub Divisional Magistrate, Kichha, District Udham Singh Nagar. Feeling aggrieved, petitioner has approached this Court seeking the following reliefs: “1. To summon the complete record pertaining to the case and, 2. To issue the writ, order or direction in the nature certiorari quashing the impugned rejection order (contained in Annexure 2 to the writ petition) whereby the application of the petitioner for the grant of Survivor/Successor Certificate has been rejected and 3. To issue the writ, order or direction in the nature of mandamus directing respondent authorities to grant the petitioner survivor/successor certificate as she being the only survivor of the family of her deceased son.” 3. Learned State Counsel submits that petitioner has remedy of approaching Additional District Magistrate, as per Notification dated 20.06.2022, issued by Department of Personnel 2025:UHC:7949 and Vigilance. Clause 6 of said notification provides that First Appeal in respect of application for survivorship certificate would lie before Additional District Magistrate/Chief Development Officer. 4. Mr. Pankaj Miglani, learned counsel appearing for petitioner submits that petitioner is ready to approach the competent authority and for this purpose she may be given ten days’ time. 5. Accordingly, Writ Petition is disposed of by permitting petitioner to file appeal before the competent authority within ten days from today. If petitioner files appeal before the competent authority within the stipulated time, decision thereupon shall be taken within four weeks thereafter. 6. It goes without saying that all other stakeholders shall also be heard by the Appellate Authority.
