The instant review petition has been filed by the petitioner for review of the order dated 11.03.2022 passed in W.P.(S) No. 467 of 2021.
2. At the outset, learned counsel for the petitioner submits that W.P.(S) No. 467 of 2021 was disposed of with a direction to the respondents to decide the case in the light of the judgment rendered in Dukhu Ram Kuiry case. He further submits that now in view of the development that the
order passed by the writ Court in Dukhu Ram Kuiry case has been set aside in LPA No. 658 of 2018; the instant review petition may be disposed of by giving liberty to the petitioner to file a fresh representation before the concerned respondent and the concerned respondent be directed to take a

decision with regard to the claim of the petitioner in accordance with law and applicable rules and regulations.

Learned counsel for the respondents submits that Dukhu Ram Kuiry case is not applicable with regard to the claim made by the petitioner. However, he does not have serious objection with respect to the petitioner approaching the concerned respondent by filing a fresh representation.

Having regard to the aforesaid facts and circumstances of the case, the instant civil review petition stands disposed of by modifying the order passed in W.P.(S) No. 467 of 2021 to the extent that the petitioner would be by at liberty to file a fresh representation along with all details/documents before the concerned respondent with regard to the claim made by her in the original writ petition.
The moment such representation is received by the concerned respondent, it will look into the matter and after verification of record shall pass an appropriate order in accordance with law and applicable rules and regulations within a period of 12 weeks from the date of receipt of such representation.
5. It goes without saying that if the order is passed in favour of the petitioner, the same shall be implemented within a further period of 4 weeks.
