Order dated 21.10.2024 passed by the Gram Panchayat Adhikari, Kushahara, Gorakhpur is under challenge in the present petition. 2. It is argued that the aforesaid order is in complete violation of judgement and order passed by this Court dated 08.01.2019 in Civil Misc. Writ Petition No. 41002/2018 (Gangotri Vs. State of U.P. and 3 Others). 3. A preliminary objection has been raised by learned Standing Counsel appearing on behalf of State-respondent that against the aforesaid order statutory alternative remedy is available with the petitioner to file an appeal before Sub-Divisional Officer as provided Under Rule 6-A of the U.P. Panchayat Maintenance of Family Register Rules, 1970, 4. In this view of the matter the present petition is dismissed on the ground of statutory alternative remedy. 5. It is made clear that in case the petitioner file an appeal as provided under Rule 6-A of Rules, 1970 within a period of three weeks from day, the appellate authority shall consider and decide the same expeditiously. 6. It is made clear that the appellate authority will not dismiss the appeal only on the ground of laches. (Prakash Padia,J.)
