This writ petition has been filed with the following prayer:- "(i) issue a writ, order or direction in the nature of MANDAMUS commanding the respondent no.2 (Up Ziladhikari Martinganj, District: Azamgarh) to consider and decide the pending Suit No.T202115060801573 of 2023 (Ram Akashayawar Vs. Lal Chand and others). u/s 116 U.P. Land Revenue Code 2006 about Arazi No.1455 area 0.3190 hectare, Village: Gosari, Pargana: Nizamabad, Tehsil: Martinganj, District: Azamgarh, within period stipulated by this Hon'ble Court." 2. It is contended that partition suit filed under Section 116 of the U.P. Revenue Code, 2006 is pending consideration which is registered as Suit No.T202115060801573 of 2023. The sole prayer made in the writ petition is for expeditious disposal of the said case. 3. As no useful purpose would be served in keeping the matter pending, or calling for counter affidavit or issuing notice to the private respondents, the matter is being disposed of, at the admission stage, with a direction upon respondent no.2- Up Ziladhikari Martinganj, District: Azamgarh to decide the Suit No.T202115060801573 of 2023, filed under Section 116 of the U.P. Revenue Code, 2006, after hearing all the concerned parties, strictly in accordance with law expeditiously preferably within a period of six months from the date of production of certified copy of this order. With the aforesaid direction, present writ petition stands disposed of. It is made clear that this Court has not adjudicated the case on merit.
