Biswas, learned counsel for the applicants and also heard Mr. G. Imtiaz, learned counsel for the respondents/opposite parties. 2. This interlocutory application under Order XXII Rule 2 of the Code of Civil Procedure, 1908, is preferred by the applicants, for substituting the name of appellant No.2, i.e. Late Parbati Devi Khakolia, who suffered demised on 11.09.2023. 3. Mr. Biswas, learned counsel for the applicants submits that appellant No.2, suffered demised on 11.09.2023, and leave behind three legal heirs, namely, i) Amit Khakholia, ii) Sri Ashish Khakholia. iii) Smt. Archana Agarwal and the said legal heirs are required to be brought on record in place of the appellant No.2. 4. The learned counsel for the opposite parties, submits that he has no objection in the event of allowing this application. 5. Taking note of the submission of learned counsel for both the parties and also considering the facts and circumstances on record this I.A. stands allowed. 6. The legal heirs of the appellant No.2, shall be impleaded as respondent Nos. 2(i), 2(ii) and 2 (iii) in the RSA No. 6/2015. 7. In view of the order passed in this interlocutory application, Mr. Biswas, shall file amended cause-title in RSA No. 6/2015, within a period of one week from today. JUDGE Comparing Assistant
