The learned counsel further submitted that civil proceedings are 3 / 6 https://www.mhc.tn.gov.in/judis pending in AS.No.3 of 2024, on the file of Principal Sub Court, Tindivanam. 6.The learned Additional Government Pleader appearing on behalf of the official respondents submitted that the petitioner is attempting to prevent those who are using the Nilaviyal Padhai as an approach to the nearby burial ground. Hence, action was taken and there was no attempt made by the respondents to evict the petitioner from the subject property. 7.In the light of the specific stand taken by the respondents and also taking note of the fact that already an appeal suit is pending before the competent Civil Court, the petitioner can workout his remedy in the pending appeal. The stand taken by the respondents to the effect that no attempt is being made to evict the petitioner from the subject property is also recorded. 8.This writ petition is disposed of in the above terms. No costs.
