HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - A No. - 14039 of 2025 Court No. - 4 HON'BLE AJIT KUMAR, J.
1. Heard learned counsel for the parties and perused the records.
2. It is argued by learned counsel for the petitioner that without giving any notice and opportunity of hearing petitioner has been saddled with the liability of recovery to the tune of Rs.4,69,266/- and Rs.50,000/- has already stood deducted. It is thus claimed that the order impugned is in gross violation of principles of natural justice.
3. Learned Standing Counsel though sought to defend the order but could not demonstrate as to under which circumstances recovery has been directed and the order also does not reflect as to whether the petitioner was served with a notice prior to passing the same.
4. In view of the above, I consider it appropriate for the District Police Commissionerate, Gautam Budh Nagar to reconsider the matter of the petitioner by offering notice to him and seeking reply.
5. The appropriate steps to serve notice upon the petitioner shall be taken within a period of four weeks from the date of presentation of certified copy of this order and petitioner would be submitting his reply within a further period of four weeks thereafter and thereafter any decision shall be taken by the authority concerned.
6. Accordingly, this petition stands disposed of with aforesaid direction and until fresh decision is taken by the authority, the order passed by the Police Commissioner, Gautam Budh Nagar dated 29th August, 2025 shall remain abeyance.
7. The recovery already done shall abide by the decision to be taken by the authority concerned as directed herein above.
