1. Upon coming of this matter for consideration pursuant to previous
order and having regard to the nature of controversy involved in the petition, a process of mediation was initiated in order to explore a possibility of settlement inter-se disputes the contesting parties, being the petitioners herein and respondent 1 herein being real brothers and in furtherance thereof Mr. G.R. Tantray, appearing counsel for the petitioners herein would fairly admit that the construction raised by the respondent 1 herein is complete, put to use by respondent 1, and that the disputes and differences inter-se the parties could be set at rest amicably even now if the order of costs imposed by the trial court upon the petitioners and payable to respondent 1 in terms of impugned order dated 10.09.2018 is set aside. 2. Mr. Zahoor A. Shah, learned appearing counsel for the respondent 1 would also fairly extend his consent to the proposal made by Mr. Tantray qua the setting aside the impugned order relating to imposition of costs payable to respondent 1 by petitioners.
3. In view of the aforesaid submissions of the appearing counsel for the parties inasmuch as having regard to the record available on the file, the instant petition is settled and disposed of in the light of the aforesaid statements of the appearing counsel for the parties and consequently impugned order dated 10.09.2018 in so far it imposes costs upon the petitioners payable to the respondent 1 shall stand set aside.
