ORDER This application is filed to grant leave to the applicants/plaintiffs to sue against the defendants and items II and III of the Suit Schedule Property are situated outside the Jurisdiction of the Court.
2. According to the applicants/plaintiffs, they filed a main Suit for the relief of the partition and separate possession of the properties. The defendants are residing outside the Jurisdiction of the Court and items I and IV of the properties were situated within the Jurisdiction of the Court and items II and III of the properties were situated outside the Jurisdiction of the Court. Therefore, they filed this application.
3. Considering the reasons stated in the affidavit, the nature of relief sought for in this application, some of the properties being situated outside the Jurisdiction of the Court, the defendants also residing outside the Jurisdiction of the Court and the substantial part of the cause of action arose within the Jurisdiction of the Court, this application is allowed.
