HON'BLE SWARUPAMA CHATURVEDI, J.
1. Heard Sri Sunil Kumar, learned counsel for the petitioner, learned Standing Counsel for the State and perused the record.
2. By means of this writ petition filed under Article 226 of the Constitution, petitioner seeks a writ in the nature of mandamus to command the respondent authorities to remove the illegal encroachment made by private respondent nos. 5, 6 and 7.
3. It is contended that there is a temple situated over the land and chabutra that was constructed by his father but the land belongs to Gram Sabha and therefore, such encroachment by private persons affects general rights of the local population.
4. In our considered view, since the petitioner raises a plea, which is in the nature of public interest and he has no private grievance, petitioner should file appropriate petition in the nature of Public Interest Litigation or the Gram Sabha should approach the court or approach the concerned authorities under the U.P.
