Mr. Suman Ghosh Mr. Sankha Prasad Roy …for the State. Affidavit of service filed by the petitioner and report submitted by the State are taken on record. None appears for the private respondent despite service. Heard learned counsels for the parties. Learned counsel for the petitioner submits that pursuant to the complaint lodged by the petitioner against the private respondent and his associates, a specific case was registered and investigation is in progress but the private respondent is yet to be arrested. He has received copy of the writ petition and is present in the locality. He is continuously threatening the petitioner to withdraw the complaint. The petitioner has lodged a specific complaint before the police authority which has not been considered. It appears from the report submitted by the State that pursuant to the earlier complaint lodged by the petitioner, investigation has commenced. Four accused 2 persons have been arrested, arms have been recovered and sent for forensic examination. The police is making all possible efforts to arrest the principal accused, the private respondent herein. Pursuant to the subsequent complaint lodged by the petitioner, the police held enquiry. The contention of the petitioner could not be substantiated. It appears that the investigation has been continuing since October, 2025. The principal accused is yet to be arrested. The investigating officer is directed to take necessary steps in this regard and conduct the investigation a fair and impartial manner and take the same to its logical conclusion in accordance with law. The police shall continue their surveillance in the locale in order to maintain law and order and shall render necessary assistance/protection to the petitioner as and when sought. The writ petition is disposed of accordingly. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
