Heard Mr. Opendra Singh, learned counsel for the applicant and Mr. Sandeep Kumar Verma, opposite party/ husband in person. 2. The instant transfer application has been filed for the following relief:- "It is therefore, most respectfully prayed that this Hon'ble Court may be pleased to transfer the proceeding of case No. 1671 of 2024 (Sandeep Kumar Verma Vs. Aradhna Verma) under Section 13 of the Hindu Marriage Act pending in the Court of Additional Principal Judge Family Court, Court No.2 Kanpur Nagar to the competent Court of District Raibareilly in the interest of justice. It is further prayed that this Hon'ble Court my be pleased to stay the further proceedings of case No. 1671 of 2024 (Sandeep Kumar Verma Vs. Aradhana Verma) under Section 13 of the Hindu Marriage Act pending in the court of Additional Principal Judge Family Court, Court No.2, Kanpur Nagar, during the pendency of the present transfer application before this Hon'ble Court, otherwise the applicant shall suffer an irreparable loss." 3. Counsel for the applicant submitted that the proceeding of case No. 1671 of 2024 (Sandeep Kumar Verma Vs. Aradhna Verma) under Section 13 of the Hindu Marriage Act initiated by opposite party at Kanpur be transferred to Raibareilly. He further submitted that cases between the parties are pending at Raibareilly, as such, the proceeding of subsequent case initiated by opposite party be transferred to Raibareilly. 4. Mr. Sandeep Kumar Verma, opposite party/ husband appearing in person submitted that he has no objection for transferring the proceeding of Section 13 of the Hindu Marriage Act from Kanpur to Raibareilly. 5. Considering the facts and circumstances of the case, the instant transfer application is allowed. The proceeding of case No. 1671 of 2024 (Sandeep Kumar Verma Vs. Aradhna Verma) under Section 13 of Hindu Marriage Act in the Court of Additional Principal Judge/ Family Court, Court No. 2 Kanpur Nagar is transferred to the competent Court of District Raibareilly. Additional Principle Judge/ Family Court, Court No.2, Kanpur Nagar is directed to transmit the record of the proceeding to the Family Court at Raibareilly forthwith. The Judge, Family Court, Raibareilly is directed to decide the proceeding under Section 13 of the Hindu Marriage Act expeditiously preferably within period of four months from the date of production of certified copy of this order.
