Side) O R D E R The petitioner, who was arrested and remanded to judicial custody on 18.08.2025, for the offence punishable under Section 191(1) of BNS and Section 3 of TNPPDL Act, 1992 in Crime No.428 of 2025, registered on the file of the respondent, seeks bail. 1/5 https://www.mhc.tn.gov.in/judis Crl.O.P.No.24235 of 2025 2. According to the prosecution, the petitioner had damaged the corporation water pipe using a JCB machine and the value of the property damaged is Rs.3,000/-. The complaint was lodged by the Assistant Engineer, Tiruppur Corporation. 3. The learned counsel appearing for the petitioner submits that the co-accused has already been granted bail by this Court and further, this petitioner has no previous case pending against him. 4. Heard both sides and perused the materials available on record. 5. Considering the period of incarceration already undergone by the petitioner and the nature of the crime, this Court is inclined to grant bail to the petitioner, subject to certain conditions. 6. Accordingly, the petitioner is ordered to be released on bail on depositing a sum of Rs.5,000/- (Rupees Five Thousand only) in the account pertaining to Crime No.428 of 2025. On such deposit, the surety may be considered and on further conditions that: 2/5 https://www.mhc.tn.gov.in/judis Crl.O.P.No.24235 of 2025 [a] The petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties, each for a like sum to the satisfaction of the learned Judicial Magistrate No.III, Tiruppur, and on further conditions that: [b] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019'].
