JUSTICE DEEPAK ROSHAN ----------- For the Petitioner : Mr. Sameer Saurabh, Advocate Ms. Divya, Advocate Ms. Isha Kaushik, Advocate For the Respondents : Mr. Munna Lal Yadav (L&C)-III ---------- 16/ 26.06.2025 Petitioner has prayed for direction upon the respondents to make payment of 2nd ACP to him in the pay-scale of Rs.10,000-15,200 w.e.f. 09.08.1999 as the petitioner is entitled for the same, after quashing the letter No. 7633 dated 29.05.2012 (Annexure-10) issued by the Government of Bihar by which it has been informed to the Deputy Secretary, Personnel, Administrative Reforms and Rajbhasha Department, Govt. of Jharkhand, Ranchi in regard to the cadre of the petitioner that he does not belong to the Joint Cadre of Secretariat Personal Assistant. Petitioner has further prayed for quashing the letter No. 8928 dated 31.07.2012 (Annexure-11) as well as the letter No. 10132 dated 1.9.2012 (Annexure-11/1) issued by the Personnel, Administrative Reforms and Rajbhasha Department, Govt. of Jharkhand, Ranchi, by which it has been informed to the petitioner that he does not come under the category of Joint Cadre of Personnel Assistant, hence, he is not entitled for the 2nd ACP in the 2025:JHHC:17074 2 pay-scale of Rs.10,000-15,200. 2. Learned counsel for the petitioner submits that the issue raised in the instant writ application has already been decided by this Court in W.P.(S). No. 4125 of 2022 (Ashrit Lakra Vs. State of Jharkhand & Ors.) and as such, similar order may be passed in this case also. 3. Learned counsel for the respondents admits the aforesaid contention and submits that the case may be disposed of in the line of W.P.(S). No. 4125 of 2022. 4. Accordingly, the instant writ application is hereby disposed in the line of the same finding given in the above referred case and consequently, petitioner is hereby declared to be a member of joint service cadre of Secretariat and attached office, and as such, be granted all the benefits available to the joint service cadre employee viz. the respondents are directed to extend 2nd ACP in the pay-scale of Rs.10,000-15,200 w.e.f. 09.08.1999. 5. Consequently, the impugned orders are hereby quashed and set aside. 6. The writ petition is hereby disposed of. (Deepak Roshan, J.) kunal/-
