Heard learned counsel for the applicant and Sri Dinesh Kumar, learned counsel for the opposite party no.6. Present contempt application has been filed for violation of the order dated 2.7.2024 passed in Civil Revision No. 90 of 2024 by impleading District Magistrate, SSP, CO, SHO, Saharanpur and many other persons, even who have not party in the revision, therefore, present application is not maintainable and liable to be dismissed on the ground of misjoinder of parties. At this stage, learned counsel for the applicant submitted that he may be permitted to withdraw this application with liberty to file fresh application with proper impleadment in accordance with law. Accordingly, the application is dismissed as withdrawn with the aforesaid liberty. In case same mistake is committed again, Court would have no option, but to pass strict order against the applicant in accordance with law.
