This petition under Article 226 of the Constitution of India filed by the petitioners is directed against an interlocutory order dated 20th December, 2023, passed in OA 938/2023 by the Central Administrative Tribunal (CAT), Srinagar Bench, [“the Tribunal”], whereby the application of the petitioners for grant of interim relief has been rejected. 2. When this petition came up for consideration, this Court on 29th December, 2023, while issuing notice to the respondents for filing their response, also provided, by way of interim arrangement, that the petitioners shall be allowed to continue as Field Investigators till such appointments are made on a regular basis, with liberty to the respondents to seek vacation of this order. This interim order has been in operation since the year 29th December, 2023, and has neither been varied nor vacated. On the other hand, consideration of the petition before the Tribunal has also been stalled. 3. In the given facts and circumstances, we are of the considered opinion that this petition deserves to be disposed of by requesting the Tribunal to take up the matter for consideration on priority and pass Arif Hameed I attest to the accuracy and authenticity of this document 05.06.2025 final orders on merits. Till the petition is considered and disposed of finally, the interim order passed by this Court on 29th December, 2023, shall remain in operation. We, however, give liberty to the respondents to seek vacation of the said order in case respondents so desire. 4. Disposed of.
