Heard the learned counsel for the respective parties. This application has been preferred by the appellant for condoning a delay of 41 days in filing the appeal. Having been satisfied with the reasons assigned in this application, the delay of 41 days which had occurred in filing this appeal is condoned and this I.A. is allowed and disposed of. Cr. Appeal (DB) No. 636 of 2025
This appeal is directed against the order dated 08.01.2025 passed in ABP No. 66 of 2025 in connection with Katras PS Case No. 236 of 2023 by the learned Additional Sessions Judge-VI, Dhanbad, whereby and whereunder, the prayer for anticipatory bail of the appellant has been rejected. The allegations reveal that a dispute arose with respect to theft of battery and charger of e-Rickshaw, which escalated into a communal riot and both the sides pelted stone and bombs were also thrown at the police personnel. Several persons were apprehended, who were involved in the riot. It has been submitted by the learned counsel for the appellant that the allegations are general and omnibus in nature and considering the said circumstance some of the co-accused have been granted anticipatory bail by this Court in Criminal Appeal (DB) No. 03 of 2024 and Criminal Appeal (DB) No. 106 of 2024. Learned A.P.P has opposed the prayer for anticipatory bail of the appellant.
Regard being had to the generality of allegations levelled against the appellant and the fact that some of the co-accused have been granted anticipatory bail, as noted above, we while setting aside the order dated 08.01.2025 passed in ABP No. 66 of 2025 arising out of Katras PS Case No. 236 of 2023 by the learned Additional Sessions Judge-VI, Dhanbad direct the appellant to surrender before the learned trial court within four weeks from today and on such surrender, he shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Dhanbad in Katras PS Case No. 236 of 2023, subject to the conditions as laid down under Section 482(2) of the Bhartiya Nagrik Suraksha Sanhita, 2023. This appeal is allowed. (RONGON MUKHOPADHYAY, J.)
