Present petition has been filed by petitioner-borrower against the recourse taken by the respondents-Bank under section 13(4) of Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (for short SARFAESI Act). 3. Learned counsel for the rival parties, including the counsel for the Bank, does not dispute that settlement has taken place between the parties and the loan account stands closed.
