Instant application has been filed by the applicant under Section 482 of the Code of Criminal Procedure for quashing the Charge sheet dated 17.01.2020 alongwith cognizance order dated 17.07.2020 passed by Chief Judicial Magistrate, Dehradun as well as entire proceedings of Criminal Case No.2259 of 2020 for the offence punishable under Section 376 of IPC. 5. Heard learned counsel for the parties 6. According to the FIR, the allegation against the applicant is that applicant and respondent no.2 were got engaged on 11.07.2019; after their engagement applicant’s behaviour with respondent no.2 was not good and after the engagement he made physical relationship with respondent no.2 in a hotel, against her will and when respondent no.2 asked the applicant to marry her he denied to marry with respondent no.2. 7. Mr. Praveen Singh (applicant) is present in the Court and Ms. Santosh Chaudhary (respondent no.2/complainant) is present through V.C. They are duly identified by their respective counsel. 8. Both the parties have come to the terms that matter may be disposed of with the condition that the expenses occurred during celebration of engagement between the parties may be fulfilled and any ornament that had been gifted between the parties may be returned or otherwise, if such articles (mainly pertaining to gold) have been sold or lost may be compensated with money. Apart from that the cost of litigation may also be considered. 9. In this light both the learned counsels are requested that they consult with the parties and come into a reasonable terms of the amount that has to be paid. 10. Applicant is ready to pay a sum of Rs.70,000/- to respondent no.2. Respondent no.2 has received an amount of Rs.70,000/- through online mode on 23.05.2025. 11. In such view of the matter, C482 application is disposed of. 12. All pending applications stand disposed of.
