..... Petitioner VERSUS State of Haryana
………..... Respondent
CORAM: HON’BLE MR. JUSTICE MAHABIR SINGH SINDHU Present: Mr. R. S. Sidhu, Advocate, for the petitioner. Mr. Ashok Sehrawat, DAG, Haryana. ***** MAHABIR SINGH SINDHU
, J. (Oral) Present petition has been filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short BNSS) for grant of bail pending trial to the petitioner in FIR No.0200 dated 09.06.2024, under Sections 379-B, 326, 323, 324, 411 read with Section 34 of the Indian Penal Code, 1860, registered at Police Station Ellenabad, District Sirsa. 2. Reply filed by way of affidavit dated 06.04.2025 of Sanjeev Balhara, Deputy Superintendent of Police, Ellenabad, Sirsa, is taken on record. Copy thereof supplied to the opposite side. 3. Allegations are that petitioner along with other co-accused in furtherance of their common intention snatched mobile phone of de facto complainant Lalan Yadav and also inflicted serious injuries to him with their respective weapon. 4. Contends that petitioner is in custody since 10.06.2024; charges have already been framed on 29.10.2024; out of total 15 prosecution witnesses, only 1 has been examined so far; thus, conclusion of trial will take sufficient long time. Specifically contends that there is no criminal case pending against the petitioner. ANIL KUMAR 2025.04.09 18:41 I attest to the accuracy and integrity of this document

5. Per contra, learned State counsel, although not able to dispute the above factual position but opposed the prayer of petitioner. 6. Heard both sides and perused the paper-book. 7. Concededly, petitioner is in custody since 10.06.2024; charges have been framed on 29.10.2024 and out of total 15 prosecution witnesses, only 1 have been examined till date; therefore, conclusion of trial may take sufficient long time. It is not the allegation of State that in case, petitioner is released on bail, he shall influence the witnesses or hamper the course of trial, in any manner; thus, further incarceration of the petitioner would not serve any purpose. 8. Consequently, present petition is allowed; petitioner shall be admitted to bail on furnishing bail/surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned. 9. Petitioner shall appear on each & every date of hearing and to fully co-operate with the learned trial Court without seeking any unnecessary adjournment(s).
10. The above observations may not be construed as an expression of opinion on the merits of the case. 11. It is clarified that in case there is recurrence or any misuse of concession of bail on the part of the petitioner, State of Haryana would be at liberty to move an appropriate application for recalling of this order. 12. Pending application(s), if any, shall also stand disposed off.
