The petitioner has preferred the present writ petition inter-alias with the following prayer:- "(a) Issue, a writ or order in the nature of Certiorari for impugned order dated 31.07.2024, passed by the District Basic Education Officer, Badaun (Annexure No.1 to the writ petition). (b) Issue, a writ, order or direction in the nature of mandamus commanding and directing the respondent authorities to permit the petitioner to function as Class-IV post (anuchar) at Upper Primary School Siddhpur, Block Bisauli, District Badaun and to pay the petitioner his regular monthly salary on the said post months to months." 2. Counsel for the Respondents placed before this Court the decision taken by the District Basic Education Officer, Badaun dated 09.01.2025 by which the aforesaid order of suspension has been set aside. Simultaneously by the said order, the petitioner was transferred from the Institution in question to some other institution, the same is taken on record. 3. After going through the same, a prayer has been made by the counsel for the petitioner to dismiss the present writ petition as having become infructuous with liberty to challenge the aforesaid order by filing the fresh petition. 4. In this view of the matter, the writ petition is dismissed as having become infructuous with liberty as prayed.
