W.P.Crl.No.846 of 2025 IN THE HIGH COURT OF JUDICATURE AT MADRAS DATED: 16.09.2025 CORAM: THE HONOURABLE MR.JUSTICE N. SATHISH KUMAR W.P.Crl.No.846 of 2025 and WPMP.No.378 of 2025 Shine George ... Petitioner Versus 1.The Commissioner of Police Salem, Salem District 2.The Inspector of Police D1, Fair Lands Police Station Hasthampatti Range Salem, Salem District ... Respondents PRAYER: Writ Petition is filed under Article 226 of Constitution of India, pleased to issue a Writ of Mandamus, directing the 1st Respondent to issue a No Objection Certificate to the petitioner to run a SPA i.e. Cross relaxation massage in the name and style of PUNARNAVA AYUR CARE MASSAGE CENTRE, at No.S7, R.C.C.Building , Suria Complex, Swarnapuri,Salem, Salem District, by passing orders on the petitioners representation dated 21.07.2025. For Petitioner : Mr.N.Edwin Jeyakumar For Respondents : Mr.R.Vinothraja Government Advocate (Crl.Side) ORDER ________ https://www.mhc.tn.gov.in/judis W.P.Crl.No.846 of 2025 The petitioner seeks direction to consider the representation given to the respondent police to issue NOC to run spa. 2. Heard the learned counsel for the petitioner and learned Government Advocate (Crl.Side) and perused the materials placed on record. 3. At the outset, this Court is of the view that such a direction cannot be issued, it is for the petitioner to apply for NOC through the concerned Corporation for such license. Only on such application, police verification is required. Normally, the police officials will issue NOC to the Corporation and thereafter, the Corporation grants license. Instead of making application before the concerned Corporation, the petitioner has come up before this Court by filing a writ petition seeking for a direction to the police to issue NOC and the same cannot be granted as a matter of right. 4. Accordingly, I do not find any merits in this petition and this petition stands dismissed. No costs. Consequently, connected miscellaneous petition stands dismissed. 16.09.2025 ________ https://www.mhc.tn.gov.in/judis W.P.Crl.No.846 of 2025 dhk Index :Yes/No Internet :Yes/No To 1.The Commissioner of Police Salem, Salem District 2.The Inspector of Police D1, Fair Lands Police Station Hasthampatti Range Salem, Salem District ________ https://www.mhc.tn.gov.in/judis W.P.Crl.No.846 of 2025 N.
