(Rajasthan) (Presently Confined At Jail, Neem Ka Thana) ----Petitioners Versus State of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Vijay Singh Shekhawat, Adv., with Mr. Tejpal Rulaniya, Adv. For Respondent(s) : Ms. Manju Dave, P.P. Mr. Ajay Singh Tanwar, Adv. HON'BLE MR. JUSTICE UMA SHANKER VYAS Judgment / Order 21/07/2025 This bail application has been filed by petitioners under Section 483 BNSS/439 Cr.P.C. seeking regular bail in FIR No.484/2024 registered at Police Station Neem Ka Thana Sadar, District Neem Ka Thana for the offence(s) under Section(s) 126(2), 118(2), 109(1) & 3(5) of BNS. Learned counsel for petitioners submits that accused- petitioners are innocent and they have been falsely implicated in this case. Learned counsel further submits that charge sheet has been filed. Learned counsel also submits that accused-petitioners have been in judicial custody since 06.11.2024 and the conclusion [2025:RJ-JP:27089] (2 of 2) [CRLMB-3202/2025] of the trial will take long time, hence petitioners may be enlarged on bail. Learned Public Prosecutor appearing for the State as well as the learned counsel for the complainant(s) have opposed the bail application. Taking into consideration the overall facts and circumstances of the case and the fact that charge sheet has been filed, but without expressing any opinion on the merits and demerits of the case, this Court deems it just and proper to enlarge petitioners on bail. Accordingly, the bail application filed under Section 483 BNSS/439 Cr.P.C. is allowed and it is ordered that accused- petitioners 1.Jitesh Kumar Yogi @ Jitu S/o Shri Rishal Ram Yogi & 2.Hari Singh @ Harish S/o Shri Bhola Ram shall be released on bail, provided each of them furnishes a personal bond in the sum of Rs.1,00,000/- with two sureties of Rs.50,000/- each to the satisfaction of the trial Court, with the stipulation that petitioners shall appear before that Court on all subsequent dates of hearing and as and when called upon to do so.
