Heard learned counsel for the petitioners and learned Standing Counsel for the respondents. 2. According to the petitioners, the land which was recorded in the name of their grand father was declared as surplus under Urban Land (Ceiling and Regulation) Act, 1976. Subsequently, the Act has been repealed by Urban Land (Ceiling and Regulation) Repeal Act, 1999. Further, since the petitioners are in possession over the land, therefore, the ceiling proceedings had abated and the petitioners cannot be dispossessed. 3. Considering the aforesaid fact, we dispose off the writ petition permitting the petitioners to file appropriate application for abating the proceedings before the respondent No.2-Competent Authority, Urban Land Ceiling, Saharanpur within a period of one month from today. On submitting such application, the respondent No.2 shall consider and decide the same within a period of two months thereafter strictly in accordance with law.
