HIGH COURT OF JUDICATURE AT ALLAHABAD APPLICATION U/S 528 BNSS No. - 35789 of 2025 Court No. - 74 HON'BLE SANJAY KUMAR PACHORI, J. Sri Bharat Singh "Pankaj", learned counsel for the applicant and Sri Karunakar Singh, earned A.G.A. for the State are present. The present application u/s 528 of BNSS of 2023 has been filed with prayer to quash the order dated 22.07.2025 Additional Chief Judicial Magistrate, Court No. 6, Allahabad in Complaint Case No. 333 of 2016, under Sections 494 and 406 IPC, P.S. Sarai Mamrej, District Prayagraj, whereby an application under Section 317 read with Section 205 of Cr.P.C. (355 read with Section 228 BNSS) has been rejected. Learned counsel for the applicant fairly admits that the charge has not been framed till today. After some arguments, learned counsel for the applicant does not want to press the present application. In view of above, the present application u/s 528 of BNSS of 2023 is dismissed as not pressed with liberty to file appropriate application/proceedings before the court of competent jurisdiction. Certified copies of the relevant documents be returned to learned counsel for the applicant after retaining a photocopy of the same.
