This is the second petition under Section 483 of BNSS, 2023 for grant of regular bail in case FIR No.297, dated 26.12.2017, registered at Police Station Sadar Panipat, District Panipat, under Sections 379-B of IPC 2. Upon notice, the State counsel has appeared and has opposed the bail. Both the parties have been heard and material collected by the police during investigation has been perused. 3. Petitioner was released on bail in the present case as per order dated 29.05.2019 passed by a Co-ordinate Bench of this Court and thereafter, he was facing the trial. However, he absented on 17.03.2021 as apparent from the order dated 04.04.2024 passed by learned trial Court. As per custody certificate, which was furnished by the State counsel in Court today, petitioner has already undergone a period of 04 years 06 months and 13 days as an under trial. The trial Court order vide which the bail was dismissed shows that all the private witnesses have already been examined and in these circumstances, no useful purpose will be served by detaining the petitioner in custody any more and he deserves to be released on bail. 4. Having regard to the aforesaid factual position, but without commenting anything on the merits of the case, the bail application is allowed and petitioner is ordered to be released on bail on his furnishing bail bond and surety bond to the satisfaction of learned Trial Court/Duty Magistrate concerned, on usual terms and conditions.
