HIGH COURT OF JUDICATURE AT ALLAHABAD CRIMINAL REVISION No. - 5607 of 2025 Court No. - 86 HON'BLE NALIN KUMAR SRIVASTAVA, J.
1. Heard learned counsel for the revisionist and learned A.G.A. for the State and perused the record.
2. This Criminal Revision has been preferred against the judgment and order dated 05.08.2025 passed by the learned Civil Judge (Junior Division), F.T.C. Judicial Magistrate, Sant Kabir Nagar in Criminal Case No. 03 of 2025, (Razzaq Ahmed vs. Vinay Kumar and others) whereby the application of the complainant-revisionist under Section 173(4) B.N.S.S., police Station- kotwali khalilabad, District- Sant Kabir Nagar was rejected by the learned trial Court.
3. It is brought to the notice of this Court that on the same set of facts the aunt of the revisionist, who is said to be the injured in the same incident has already filed an application under Section 173 (4) BNSS which was treated as complaint case by the trial Court.
4. It is surprising that the present revisionist who has full knowledge of the said incident and even in his affidavit filed in support of this revision at paragraph 14 he has also narrated it but inspite of that an application under Section 173 (4) BNSS for the same offence was moved by him before the Magistrate and now he has knocked at the door of the High Court.
5. In view of the above, there is no necessity to send any notice to the opposite parties.
6. In my view this is a gross abuse of the process of the Court. The revisionist having full knowledge that criminal case in the same Versus Counsel for Revisionist(s) : Ganga Ram, Prabhat Chandra Mishra Counsel for Opposite Party(s): G.A. Razzaq Ahmed .....Revisionist(s) State Of U.P. And 12 Others .....Opposite Party(s)
matter has already been registered by the order of the Court for the same incident has filed the application under Section 173 (4) BNSS with ulterior motive only to increase the multiplicity and pendency of the proceedings in the High Court. The Court seriously deprecates the aforesaid conduct.
7. Hence, this revision is dismissed at this stage without admission. September 25, 2025 Fhd CRLR No. 5607 of 2025 2 (Nalin Kumar Srivastava,J.) Digitally signed by :- FAHAD NIYAZ High Court of Judicature at Allahabad
