THE HONOURABLFSRI JUSTICE K SREENIVASA REDDY gLRIMINAL PETITION NO: 2371 of 2025 ORDER: The Criminal Petition, under Section 482 of the Bharatiya Nagarik suraksha sanhita, 2023, is filed on behalf of the petitioner to grant anticipatory bail in connection With Crime No.33/2025 of Prohibition & Excise Station, RajamahendraVaram South, East Godavari District. 2) A case has been registered against the Petitioner for the Offence punishable u/sec.7-B read with 8A of the A.P.Prohibition Act. 3) Case of the Prosecution in brief iS that On 12.01.2025 at 04.00 pm, police received Credible information and ral'ded the Premises at Bommuru village of RajamahendraVaram Rural Mandal where they found one person stirring with stick in a plastic drum. On seeing the raid party, he ran away from the scene. Police verified the spot and found 800 liters of FJ wash in 4 plastic drums (each consists 200 liters) which was fit for distillation of ID liquor. 4) Heard. PerusedthereCOrd. 5) Learned COunSel for the Petitioner Submits that a false case is foisted against the petitioner herein and the petitioner is no way connected to the alleged crime. Further, the learned counsel for the eofz2ife.` h- petitioner submits that the petitioner neither involved in the alleged crime f? nor was present at the scene of offence. 6) On the other hand, learned Assistant Public Prosecutor opposed grant of anticipatory bail on the ground that investigation is pending. 7) A perusal of the material on record shows that the Petitioner Was not apprehended at the scene of offence.
