Although, several prayers have been made in the writ petition but at the time of making oral submission, learned counsel for the petitioner submits that the only prayer he is pressing is for issuing direction to the respondents to consider the application of the petitioner bearing Reference No. 25-0001519792 for re-issue of passport within a stipulated period. 2. Counsel for the petitioner admits that a criminal case is pending against the petitioner. He submits that the proceedings of the said case have been stayed by this Court by order dated 02.07.2025 in application under Section 528 BNSS bearing No. 21634 of 2025. 3. As it is not disputed that criminal case is still pending against the petitioner therefore, we grant liberty to the petitioner to seek no objection from the concerned jurisdictional court in terms of judgement of the Division Bench of this Court in Writ-C No. 41540 of 2023 (Pawan Kumar Rajbhar Vs. Union of India & 2 Ors, (Neutral Citation No. 2024:AHC:26720-DB) so that the application of the petitioner is processed by the passport officer. 4. We further provide that in case any application for no objection is filed by the petitioner before the concerned court, the said application will be decided without treating the order of this court dated 02.07.2025, staying proceedings of the trial, to be an impediment.
