Heard Sri Vikrant Gupta, learned counsel for the applicant, Sri Ashutosh Srivastava, learned A.G.A. for the State and perused the material placed on record. 3. Applicant seeks bail in Case Crime No.44 of 2017, under Section 3(1) U.P. Gangster Act, Police Station Bilaspur, District Rampur, during the pendency of trial. 4. Learned counsel for the applicant has argued that the applicant was on bail in the instant case, but inadvertently could not attend the court on 02.08.2021, as such, NBW was issued against him. Subsequent to it, he had surrendered before the court concerned on 02.04.2025 and is in jail since then. The criminal history assigned to the applicant stands explained. The applicant is ready to cooperate with trial and in case he is released on bail, he will not misuse the liberty of bail. 5. Learned A.G.A. has vehemently opposed the bail application. 6. Without expressing any opinion on the merits, the bail application is allowed. Let the applicant- Babu, involved in aforementioned case be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned with the following conditions that :- (i) The applicant shall not tamper with evidence during trial. Identity, status and residence proof of the applicant and sureties be verified by the court concerned before the bonds are accepted.
