Petitioner has filed petition under Section 528 of BNSS, 2023 for issuance of an appropriate order or direction to the learned Additional Sessions Judge, Amritsar, to decide the anticipatory bail application of the petitioner registered vide No.BA-4987-2025, dated 03.07.2025, titled as “Pallvi Vs. State of Punjab” (Annexure P-5) in FIR No.83, dated 24.06.2025, under Sections 318(4) and 61(2) of the BNS, 2023 and Section 13 of the Punjab Travel Professionals (Regulation) Act, 2014, registered at Police Station Kathunangal, Amritsar Rural, District Amritsar (Annexure P-1). 2. Learned counsel for the petitioner contended that no offence under Sections 318(4) and 61(2) of BNS, 2023, and Section 13 of Punjab Travel Professionals (Regulation) Act is made out against the present petitioner. The petitioner has no involvement or role in the transaction between the complainant and the co-accused, and the petitioner is only witness in the said agreement. On the asking of the Court, Mr. Subhash Godara, Addl. A.G. Punjab, accepted notice on behalf of State of Punjab. 5. Heard. 6. Perusal of zimni orders (Annexure P-5) passed by the trial Court shows that some time the police record is not produced and some time the Investigating Officer is not available. According, the petition is accordingly disposed of with a direction to the Superintendent of Police, Amritsar (Rural) to look into the matter and produce all the relevant record before the concerned trial Court. The concerned trial Court is also directed to follow the directions laid down in “Satendra Kumar Antil Vs. CBI” 2022 AIR SC 3386, regarding disposal of anticipatory bail application within stipulated time. 7. Copy of order be communicated to Senior Superintendent of Police (Rural) through State counsel.
