Heard the counsel for the petitioners and the AGA for the State respondents. The present writ petition has been filed challenging the impugned First Information Report dated 03.07.2025 registered as Case Crime No.157 of 2025, under Section 331 (4), 305 (a), B.N.S., 2023 Police Station-Kotwali Dehat, District-Band. It has been argued by the counsel for the petitioners that the recitals in the first information report are false and there is no evidence to either suspect or to implicate the petitioners in the aforesaid offence. It has been argued that no recovery has yet been made from the petitioners. The first information report has been registered with the male fide purpose only to harass the petitioners. The AGA has opposed the petition. In the circumstances of the case and after considering the rival arguments of the counsel for the parties, the writ petition is disposed of with a direction that the petitioners shall not be arrested in pursuance to the First Information Report dated 03.07.2025 registered as Case Crime No.157 of 2025, under Section 331 (4), 305 (a), B.N.S., 2023 Police Station-Kotwali Dehat, District-Band till submission of the police report under Section Versus Counsel for Petitioner(s) : Nitin Pal, Shivam Kumar Pal, Shobhit Sharma Counsel for Respondent(s) : G.A.
