1. The present petition has been filed under Articles 226/227 of the Constitution of India inter alia seeking issuance of a writ in the nature of Mandamus for staying the dispossession of the petitioner during the pendency of the appeal (Annexure P-5) filed by the petitioner against the eviction order dated 16.05.2025 (Annexure P-4) passed by Collector Beri, District Rohtak.
2. At the outset, learned counsel for the petitioner submits that after the filing of the appeal (Annexure P-5) by the petitioner against the
order dated 16.05.2025 (Annexure P-4), the demised premises has been sealed and, therefore, he may be permitted to withdraw the present petition with liberty to the petitioner to move necessary application in the aforesaid appeal (Annexure P-5) itself for necessary relief and also to pray for early hearing of the appeal (Annexure P-5). 3. In view of the above, the present writ petition is dismissed as withdrawn with the liberty aforesaid.
