Heard the counsel for the petitioners and the A.G.A. for the State. The present petition has been filed challenging the First Information Report registered with Case Crime No. 180 of 2025, under sections 316(5), 319(2), 318(4), 338, 336(3) and 340 (2) of B.N.S., Police Station Ashothar, District Fatehpur. It has been argued by the counsel for the petitioners that the petitioners have no role to play in the payment of dues to the labours under the MGNREGA Programme and it is the Sector Officer who is responsible to physically verify the list of beneficiaries supplied by the concerned Gram Panchayat. It has been further stated that the first information report has been registered with the mala fide intention to implicate the petitioners and to save the persons actually responsible for the offence referred in the first information report. The AGA has opposed the petition. In the circumstances of the case and after considering the rival arguments of the counsel for the parties, the writ petition is disposed of with a direction that the petitioners shall not be arrested in pursuance to the First Information Report registered with Case Crime No. 180 of 2025, under sections 316(5), 319(2), 318(4), 338, 336(3) and 340 (2) of B.N.S., Police Station Ashothar, District Fatehpur till submission of the police report Versus Counsel for Petitioner(s) : Saurabh Chaturvedi Counsel for Respondent(s) : G.A.
