The petitioner has been made accused in connection with Garhwa Nagar P.S. Case No. 21 of 2024, S.T. No.302 of 2024, for the offence registered under Sections 302 & 120-B of the Indian Penal Code but charge framed under Sections 498-A and 306/34 of the Indian Penal Code, pending in the court of learned Additional Sessions Judge-I, Garhwa. Petitioner happens to be the husband of the deceased namely Ruksar Khatoon, who died due to Asphyxia because of hanging in her matrimonial home. Statements of several witnesses have been recorded during trial in which it appears that the petitioner was having illicit relationship with another lady, due to which, deceased committed suicide. Learned counsel for the petitioner submitted that all the witnesses including the informant have been declared hostile in this case. Considering the nature of allegation, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-I, Garhwa, in connection with Garhwa Nagar P.S.
