Jyotsna Rewal Dua, Judge Learned counsel for the parties jointly submit that this Arbitration Appeal arises out of judgment dated 04.12.2021, passed by the learned District Judge, Mandi, District Mandi, H.P. in a bunch of matters pertaining to Mohal Chamukha, Tehsil Sundernagar, District Mandi with lead case Arbitration Petition No.13 of 2018 (National Highways Authority of India Versus Babu Ram). It was submitted that Arbitration Appeal No.1 of 2024, arising out of Arbitration Petition No.38 of 2018, has been decided on 18.09.2024. That the aforesaid judgment and findings Whether reporters of Local Papers may be allowed to see the judgment? Yes -2- therein will mutatis mutandis apply to the facts of instant Arbitration Appeal arising out of Arbitration Petition No.24 of 2018, which was part of bunch of Arbitration Petitions decided by learned District Judge Mandi, H.P. vide judgment dated 04.12.2021. 2. In view of above submission, this appeal is also decided in terms of the decision rendered in National Highway Authority of India Vs. Brestu Ram1. The decision therein shall mutatis mutandis apply to the present appeal. Consequently, the present appeal is dismissed and the award passed by the learned Arbitrator is affirmed.
