JUSTICE SANDEEP MOUDGIL Present: Mr. Amarjeet Beniwal, Advocate for the petitioner(s). **** SANDEEP MOUDGIL, J (ORAL) This writ petition has been filed under Article 226/227 of the Constitution of India for quashing of impugned order dated 16.06.2025 passed by respondent No.1 whereby his suspension period are ordered to be treated as extra ordinary leave and for direction to respondents to treat the suspension period from 25.11.2022 to 07.02.2023 as duty period and to release all consequential benefits including full pay and allowances, continuity of service, pension fixation and seniority etc. Learned counsel for the petitioner submits that the petitioner has been exonerated in the enquiry report and was reinstated in service vide order dated 03.02.2023 with the posting at Panipat as Food Safety Officer, therefore, he be released all consequential benefits including full pay and allowances, continuity of service, pension fixation and seniority etc. Notice of motion. A.G., Haryana learned State Counsel appearing on advance notice accepts notice on behalf of respondent-State. He however submits that the petition discloses reference to a representation dated 23.06.2025 (Annexure P-5) and in case such representation has been made, the same will be decided within a period of 6 weeks from today by passing a speaking order but at times, no such representation is made as the petition does not contain any proof qua service of such representation. Having find weight in the submission of learned State Counsel, this Court would deem it appropriate to direct the competent authority that Addition Chief Secretary, Department of Health, Haryana Civil Secretariat, Chandigarh to consider the instant petition as representation, in case no such representation is received in his office. A copy of order so passed be supplied to the petitioner within seven days thereafter. Petition stands disposed of in the aforesaid terms.
