Heard the counsel for the petitioner, the A.G.A. for the State and Sri Aditya Gupa, counsel representing the informant. The present petition has been filed for the following reliefs:- "i) Issue a writ, order or direction in the nature of Certiorari, quashing the impugned F.I.R. dated 27.08.2025 of Case Crime No. 0181 of 2025 under sections 75(2), 76, 352, 351(2), 115(2) B.N.S., 2023 and Section 9(f) and 10 of Protection of Children from Sexual Offencs Act, 2012, Police Station Mainether, District Muradabad. ii) Issue a writ, order or direction in the nature of Mandamus commanding the respondent authority not to arrest the petitioner in connection of the F.I.R. dated 27.08.2025 of Case Crime No. 0181 of 2025 under sections 75(2), 76, 352, 351(2), 115(2) B.N.S., 2023 and Section 9(f) and 10 of Protection of Children from Sexual Offencs Act, 2012, Police Station Mainether, District Muradabad " It has been stated by the A.G.A. that Section 64 (2) of B.N.S. has been added by the Investigating Officer during the course of investigation. The recital in the first information report discloses commission of cognizable offence. In view of the aforesaid, no case for quashing the first information report is made out. For the aforesaid reason, the present writ petition is dismissed. September 23, 2025 n.u.
