Pathak learned Standing Counsel for the State and Mr. Sudhir Bharti, learned counsel for the Gaon Sabha. 2.The instant petition has been filed for the following relief:- "i. issue a writ, order or direction in the nature of the mandamus commanding the Respondent No.2 to adjudicate and decide the Appeal No.2047/2019 and Computer Case No.201954053100002047, (Surendra and others versus Krishanpal and others) under Section 11 (1) Uttar Pradesh Consolidation of Holdings Act, 1953 in Mauza- Madar, Tappa-Uttar Haweli, Pargana-Hasanpur Maghar, Tahsil- Sahjanwa, District-Gorakhpur is pending before Settlement Officer of Consolidatin, Gorakhpur, (Respondent No.2) since 13.11.2019 within the stipulated period fixed by this Hon'ble Court." 3. Learned counsel for the petitioner submitted that the aforementioned title appeal filed by the private respondent impleading the petitioner as opposite party is pending before respondent no.2-Settement Officer of Consolidation, Gorakhpur since 13.11.2019. He further placed certified copy of the order sheet, which has been annexed as Annexure No.2 to the writ petition in order to demonstrate that the case is not proceeding expeditiously. 4. Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally directing respondent no.2-Settement Officer of Versus Counsel for Petitioner(s) : Satya Priya Mishra Counsel for Respondent(s) : C.S.C., Sudhir Bharti Madhusudan .....Petitioner(s) State Of U.P. And 46 Others .....Respondent(s) Consolidation, Gorakhpur to decide the aforementioned title appeal in accordance with law expeditiously and preferably within a period of three months from the date of production of certified copy of this order after giving opportunity of hearing to both the parties.
