Heard Mr. M.M. Zaman, learned counsel for the applicant; Ms. G. Hazarika, learned Standing Counsel, Revenue & Disaster Management Department for the opposite party- respondent no. 1; and Ms. S. Baruah, learned Junior Government Advocate, Assam for the opposite party-respondent nos. 2 & 3. 2.
The instant interlocutory application is filed by the applicant seeking impleadment of the following persons :-
[4] Apurba Kumar Medhi,
[5] Amiya Kumar Medhi,
[6] Rajib Kumar Medhi,
Page No. 4/5 [7] Bhabani Mohan Medhi, All are sons of Late Karuna Kanta Medhi, resident of Village – Kamalazari, P.O. & Mouza – Dimoria, District – Kamrup [Metro], Pin- 782402, Assam. as party-respondent no. 4 to party-respondent no. 7 respectively in the connected writ petition, W.P.[C] no. 6891/2024. 3. The applicant as the writ petitioner has preferred the connected writ petition, W.P.[C] no. 6891/2024 assailing an Order dated 12.12.2024 passed by the opposite party-respondent no. 3 and also for a direction to the opposite party-respondent nos. 2 & 3 to issue Land Sale Permission to the applicant-petitioner. 4. It is stated in the application that the impugned Order dated 12.12.2024 has been passed by the opposite party-respondent no. 3 in view of a pending litigation between the applicant-writ petitioner and the proposed party-respondents and in such view of the matter, their presence in the connected writ petition is necessary. 5. The prayer for impleadment is not opposed by the learned counsel for the Official respondents. 6. I have gone through the statements and averments made in the application seeking impleadment of the afore-mentioned persons as party-respondents in the connected writ petition. Having gone through the statements and averments made in this writ petition, this Court is of the considered view that presence of the afore-mentioned persons as party-respondents in the connected writ petition is necessary for proper and effective adjudication of the issues involved in the connected writ petition. Accordingly, the instant interlocutory application is allowed. 7. The applicant-writ petitioner shall file an amended cause-title in terms of the Notification no.
79 dated 19.06.2023 within 3 [three] working days from today and on filing of such amended cause-title, the Registry shall carry out the necessary corrections in the cause-title of the connected writ petition as well as in the CIS and list the writ petition for admission immediately
