The present applicant ‘Vivek S/o Hansraj Rajput’, is praying for bail in relation to First Information Report dated 04.06.2025 bearing FIR No. 267 of 2025, P.S. Patel Nagar, District Dehradun which was lodged against unknown person for the offence punishable under Section 304 of BNS, 2023. 4. It is submitted by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated and have no previous criminal history. 5. Apart from this, she submits that the applicant has been implicated and charge sheeted for the offences punishable under Sections 304(2), 317(2) and 3(5) of BNS, 2023, and is languishing in jail since 04.06.2025 and all the offences are triable by Magistrate. She further submits that applicant is pursuing B.A. (Honours) from DAV College, Dehradun. 6. On the previous date, learned State Counsel was directed to get instructions and apprised to this Court about the criminal history of the applicant. On instructions, learned AGA submits that applicant have criminal history of one case relating to similar nature of offence. 7. On the other side, learned A.G.A. Mr. Sandeep Sharma have also not disputed this fact that the offences in which the applicant has been implicated are triable by Magistrate and charge sheet has already been filed. 8. After hearing the arguments of learned counsel for the parties and further taking into consideration that all the offences are triable by the Magistrate and charge sheet has already been, therefore, there is need of custodial interrogation, this court is of the view that the applicant deserves for bail. 9. Accordingly, without expressing any opinion on the merit of the case the bail application is allowed. 10. Let the applicant ‘‘Vivek S/o Hansraj’’ be 2025:UHC:7168 released on bail on furnishing his personal bond and two sureties each of the like amount to the satisfaction of the court concerned.
