JUSTICE VINOD CHATTERJI KOUL-JUDGE ORDER 01.01.2025 Petitioners are seeking following reliefs in this petition: “…I. By issuance of writ of certiorari, the impugned orders issued by the respondents or by the office of Principal Accountant General’s Office through Senior Accounts Officer (PNR-3) or other officers to this effect be quashed and set aside, as reflected in Annexure-I collectively, within reversion of petitioners from promoted posts and grades have ordered. II. By issuance of writ of Mandamus, respondents be directed to release all pensionary benefits in favour of the petitioners as per the grade drawn by them at the time of their retirement and release all arrears with interest at the rate of 12% till realization of the same in favour of the petitioners. III. Further by issuance of appropriate writ, order or direction including writ of prohibition, prohibiting the respondents from effecting any recovery from the petitioners so as to meet the ends of justice. IV. Respondents be directed to grant same treatment to the petitioners as has been done in the case of Mohd Abdullah Bhat, Abdul Rehman Parray, and Ghulam Nabi Bhat. V, Respondents be further directed to settle the claim of the petitioners in light of judgment dated 20.05.2013 passed in SWP no. 767/2012 titled Bashir Ahmad Bhat Vs. Sate and ors., which stands followed in many other Judgments, as the case of the petitioners squarely covered by the aforesaid Judgments.” Learned counsel for the petitioners submits that instant writ petition can be disposed of in light of Judgment passed by the Division Bench in WP(C) no. 296/2024, as the instant petition is squarely covered by the said Judgment. In view of the submissions made by learned counsel for the petitioners, this petition is disposed of with a direction to the respondents to consider the claim of the petitioners as projected by them in this petition in line with the observation made in Judgment (supra), provided the case of the petitioners is squarely covered by the said Judgment. This writ petition is disposed of along with connected CM(s).
