Sri Preet Pal Singh Rathore, learned counsel for the applicant and Sri Karunakar Singh, learned A.G.A. for the State are present. The present application u/s 528 of BNSS of 2023 has been filed with prayer to quash the entire proceeding of Execution Case No. 32 of 2025 and Execution Case No. 108 of 2024, arising out of an application under Section 147 B.N.S.S. (128 of Cr.P.C.), pending in the court of Principal Judge, Family Court, Budaun as well as judgment and order dated 12.02.2008 passed in Maintenance Case No. 414 of 2006, arising out of an application under Section 125 of Cr.P.C, whereby maintenance order has been passed as well as order dated 15.09.2022 in Case No. 259 of 2021, arising out of an application under Section 127 of Cr.P.C., in which maintenance amount has been enhanced. After some arguments, learned counsel for the applicant does not want to press the present application. In view of above, the present application u/s 528 of BNSS of 2023 is dismissed as not pressed with liberty to file appropriate application/proceedings before the court of competent jurisdiction.
