ORDER: The learned counsel for the petitioner is aggrieved by the docket
order dated 05.02.2025 passed in M.C. No.06 of 2023 on the file of the learned Judicial First Class Magistrate, Nandikotkur. By the said docket
order, the learned Magistrate declined to accept the chief affidavit filed by P.W.1 and
directed the petitioner to produce accordance with Section 126 of the Code of Criminal Procedure, 1973 (Cr.P.C.). evidence in
2. It IS the contention of the learned counsel for the petitioner that Section 126 Cr.P.C. does not mandate that the evidence should be ' recorded in the physical presence of the Magistrate, but only requires the presence of the person against whom an order for maintenance is proposed to be made.

Upon hearing the learned counsel for the petitioner and perusal of the material available on record, as well as considering the legal position under Section 126 Cr.P.C., this Court is of the considered view that the impugned docket order passed by the learned Magistrate is not legally sustainable apd is liable to be set aside. on
3 Accordingly, the docket order dated 05.02.2025 passed in M.C. No.06 of 2023 on the file of the Judicial First Class Magistrate, Nandikotkur is hereby set aside. The chief affidavit of P.W.1 shall be treated as examination-in-chief. The learned Magistrate is directed to proceed further with the matter in accordance with law.

5. Accordingly, the Criminal Petition is disposed of. As a sequel thereto, miscellaneous applications, if any, pending in this Criminal Petition shall stand closed. There shall be no order as to costs.
