On 10.07.2023, the petitioner was consuming liquor with his wife, there was some altercation between them due to which the petitioner picked up a Roti pin and assaulted his wife due to which she succumbed to her injuries. Learned lawyer for the petitioner submitted that the occurrence has taken place due to spur of the moment. It was further submitted that no case under section 302 will be made out against the petitioner.
