The instant writ petition has been filed for following relief: "Issue an Order or direction to the court to consider and decide the application no. 35 C filed in civil suit no. 57 of 2022 (Sanjeev Kumar vs. Pradeep Kumar and Another) pending in the court of Civil Judge (Senior Division), Jalesar, Etah, expeditiously within a stipulated period as this Hon'ble Court deem fit so under the facts and circumstances of the case. ii. Issue an Order or direction to the Civil Judge (Senior Division), Jalesar, Etah to decide and adjudicate the civil suit no. 57 of 2022 (Sanjeev Kumar vs. Pradeep Kumar and Another) pending in the court of Civil Judge (Senior Division), Jalesar, Etah, expeditiously within a stipulated period as this Hon'ble Court deem fit so under the facts and circumstances of the case." 3. Contention of the learned counsel for the petitioners is that the aforementioned application no. 35 C in civil suit no.57 of 2022 is pending for adjudication. He prayed that the same may be decided expeditiously. 4. The present petition stands disposed of finally with a direction to the Civil Judge (Senior Division), Jalesar, Etah to consider and decide the aforementioned application no. 35 C of the petitioner, in accordance with law, expeditiously, preferably within a period of twelve weeks from the date of production of a certified copy of this order after ensuring service upon all the respondents, after giving opportunity of hearing to the parties concerned provided that there is no other legal impediment.
