The present writ petition has been filed challenging the impugned First Information Report dated 20.02.2024 registered as Case Crime No. 131 of 2024, under Section 419, 420, 467, 468, 471, 120-B I.PC., Police Station Pipraich, District Gorakhpur. It has been argued by the counsel for the petitioner that in the first information report no role has been assigned to the petitioner in the particular incident which was the cause for lodging the first information report. It has been argued that only vague allegations have been made against the petitioner and no act of the petitioner referred in the first information report amounts to an offence noted in the first information report. It has been further argued that the dispute between the parties is essentially civil in nature and relates to the identity and name of the father of the main accused. The A.G.A. has opposed the petition. In the circumstances of the case and after considering the rival arguments of the counsel for the parties, the writ petition is disposed of with a direction that the petitioner shall not be arrested in pursuance to the First Information Report dated 20.02.2024 registered as Case Crime No. 131 of 2024, under Section 419, 420, 467, 468, 471, 120-B I.PC., Police Station Pipraich, District Gorakhpur till submission of the police report under Section 193 of Bhartiya Nyaya Sanhita, 2023.
