HIGH COURT OF JUDICATURE AT ALLAHABAD CRIMINAL MISC. ANTICIPATORY BAIL APPLICATION U/S 482 BNSS No. - 7558 of 2025 Court No. - 69 HON'BLE VIVEK VARMA, J. 1. Sri Narendra Singh Chahar, Advocate has filed vakalatnama on behalf of informant. The same is taken on record. 2. Heard counsel for the applicant, counsel for the informant, Sri V.P. Tripathi, learned AGA for the State and perused the material on record. 3. The present application has been filed with the prayer to grant anticipatory bail to the applicant in Case Crime No. 56 of 2025, under Sections 115(2), 352, 351(2), 109 of B.N.S., Police Station- Chola, District- Bulandshahr. 4. Counsel for the applicant submits that the applicant has been falsely implicated in the present case. Vague and general allegations have been levelled against the applicant. The applicant has no criminal antecedents. It is next contended that the investigation is going on and the applicant has apprehension of his arrest in the above mentioned case. 5. On the other hand, learned AGA and counsel for the informant have opposed the prayer for anticipatory bail. Learned A.G.A. submits that in the alleged incident, four persons namely Rajkumar-informant, Arun, Shivam and Chanchal received injuries. According to the medical report of Rajkumar, he received eight injuries. As per the supplementary medical report, the injury nos. 1, 2 and 6 of Rajkumar were on vital parts of the body and were grievous in nature. 6. Having heard learned counsel for the parties and having perused the Versus Counsel for Applicant(s) : Rakesh Kumar Maurya Counsel for Opposite Party(s) : G.A. Rajveer .....Applicant(s) State of U.P. .....Opposite Party(s) record, this court prima facie finds that in the alleged incident four persons namely Rajkumar-informant, Arun, Shivam and Chanchal received injuries. According to the medical report of Rajkumar, he received eight injuries. As per the supplementary medical report, injury nos. 1, 2 and 6 were grievous in nature. As per the statement of the doctor, the said injuries were dangerous to life. The prosecution case is supported by injured persons as well as eye witnesses namely Jagvir Singh, Manoj, Vijay Kumar, Naresh Chaudhary and Sunil. 7. The offence is grave. There is likelihood that the applicant has committed the offence. In my opinion, this is not an appropriate case for grant of anticipatory bail. Hence the application is hereby rejected leaving it open to the applicant to apply for regular bail before the concerned court, which application when filed, may be considered on its own merits, without being prejudiced by any observation made in this order.
