1. Petitioner was an employee of Security Printing and Minting Corporation of India Limited (hereinafter referred to as ‘Corporation’) who retired on superannuation on 1st September, 2023. 2. Grievance of the petitioner is two-fold-delayed payment of overtime allowance as per 7th Central Pay Commission recommendation and release of production incentive allowance not at an appropriate rate. 3. Petitioner prays for interest on revised overtime allowance due to delayed payment and payment of production incentive allowance at revised rate. 2
4. Learned advocate representing respondents has submitted that 7th Central Pay Commission recommendation was adopted by the Corporation on 4th May, 2017 with effect from 1st January,
2017. According to Corporation as 7th Central Pay Commission recommendation was made effective with retrospective effect based on its adoption on 4th May, 2017 petitioner may not be entitled to get interest on revised overtime allowance. 5. From the submissions made on behalf of the parties it appears that Corporation adopted 7th Central Pay Commission recommendation on 4th May, 2017 with effect from 1st January, 2017 as a result whereof petitioner was entitled to receive revised benefits under overtime allowance with effect from 1st January, 2017. As date of adoption so far Corporation is concerned is 4th May, 2017 delay caused in releasing revised benefit upto 4th May, 2017 is not attributable to said Corporation. However, petitioner is entitled to receive interest on revised benefits towards overtime allowance as per 7th Central Pay Commission recommendation from 5th May, 2017 being the date following the date of adoption i.e. 4th May, 2017. 3

Hence, concerned authority of Security Printing and Minting Corporation of India Limited is directed to pay interest @ 6% per annuam on revised benefits towards overtime allowance as per 7th Central Pay Commission recommendation from 5th May, 2017 till date of payment by 8 (eight) weeks from the date of communication of this order. 7. Petitioner shall also be at leave to make a representation for appropriate quantification of production incentive allowance by fortnight from date before the General Manager of Corporation being respondent no. 2. 8.
If such representation is made within the aforesaid time respondent no. 2 shall decide the same in accordance with law by 10 weeks thereafter on passing reasoned order and same shall be communicated to the petitioner by fortnight thereafter. 9. Writ petition stands disposed of. 10. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings. (Saugata Bhattacharyya, J.)
