1. The petitioner has filed the present writ petition under Article 226 of the Constitution of India with a prayer to issue a writ in the nature of Mandamus directing respondents to grant the benefits of advertised pay scale i.e.10300-34800 plus 3200 Grade Pay, pay fixation and other consequential benefits. A further prayer has been made to release all service benefits at par with other selected and appointed persons in pursuance to advertisement/ selection process dated 01.09.2016 (Annexure P-1).
2. A further prayer has been made to issue a writ in the nature of Certiorari for quashing the relevant clauses of the appointment letter dated 16.08.2021 (Annexure P-5).

Learned counsel for the petitioner contends that the case of the petitioner is squarely covered by the ratio of the law laid down by this Court in CWP-15896-2023 (O&M), titled as “Saurabh Sharma and others Vs. State of Punjab and Anr.” dated 13.09.2024.

Learned counsel further submits that the petitioner has already submitted a representation dated 04.07.2025 (Annexure P-9) to respondent No.2 HITESH 2025.09.01 16:02 I attest to the accuracy and authenticity of this document/judgment High Court, Chandigarh
CWP-25851-2025 -2 and he shall be satisfied in case, appropriate directions are issued to the respondent No.1 to decide the representation dated 04.07.2025 (Annexure P-9) in a time bound manner.

6. On the asking of the Court, Mr. Charanpreet Singh, AAG, Punjab, who is present in the Court, accepts notice on behalf of the official respondents and has no serious objection to the prayer made by learned counsel for the petitioner, at this stage.
7. I have heard learned counsel for the parties and perused the record carefully.

At this stage, it would be appropriate to direct the respondent No.1 to decide the representation dated 04.07.2025 (Annexure P-9) in view of the law laid down by this Court in CWP-15896-2023, titled as “Saurabh Sharma and others Vs. State of Punjab and Anr.” dated 13.09.2024 within a period of four months of date of receipt of certified copy of this order.

Needless to observe that the respondent No.1 shall pass a speaking and well reasoned order in the light of the above referred judgment as well as relevant rules/instructions and in case, it is found that the petitioner is entitled to relief claimed in the representation, consequently, all consequential benefits may also be released to the petitioner, without any further delay.
